The Settlement and Clearing House (hereinafter referred to as RCP) is a structural subdivision of the Commodity Exchange, is the main link in the mechanisms of futures-forward trading, conducting export-import operations on commodity exchanges and ensuring settlements and mutual settlements between clients on exchange transactions. The activities of the RCP are based on the Regulations on the Clearing and Settlement Chamber of the RUAPB
DOCUMENTS REQUIRED FOR JOINING A MEMBERSHIP AND OPENING ACCOUNT WITH THE SETTLEMENT AND CLEARING CHAMBER (CCH) OF THE EXCHANGE
- an application for opening an account;
— contract for clearing services;
— a card of sample signatures.
(Issuance of an application, contract, signature sample card is issued after the submission of the following documents)
1. FOR NON-RESIDENTS:
a) for foreign countries:
- an application for opening an account;
- a copy of the passport of the head or authorized representative;
- legalized / apostilled constituent documents certifying the state registration of the enterprise (copies, notarized) - annual renewal of the certificate of registration is expected;
- legalized / apostilled document confirming the appointment of the head (copies, notarized);
- legalized / apostilled power of attorney for the representative of the company (copy, notarized);
- A bank statement confirming the existence of an account.
The text of the power of attorney must include:
“He has the right to open accounts in the clearing houses of commodity exchanges and dispose of the funds on these accounts, conclude and sign on behalf of the principal agreements for settlement and clearing, brokerage services and perform other legally significant actions.”
b) for CIS countries:
- an application for opening an account;
- a copy of the passport of the head or authorized representative;
- certificate of state registration of a legal entity (copy, notarized);
- extract from the unified state register of legal entities (copy, notarized)
- an order for the head, or a power of attorney for the representative of the company (notarized);
- charter (copy), certified by the seal of the enterprise;
- A bank statement confirming the existence of an account.
2. FOR RESIDENTS
- an application for opening an account;
- a copy of the passport of the head or authorized representative;
- certificate of state registration of a legal entity (copy, notarized);
- certificate of the right to wholesale trade (if necessary);
- an order for the head or a notarized power of attorney for the representative of the company;
- charter (copy), certified by the seal of the enterprise;
- A bank statement confirming the existence of an account.
The signing of the agreement on settlement and clearing services and the transfer of a copy to the RCP member is carried out after the submission of the above documents. The signature sample card is drawn up in the presence of an employee of the RCP and the head of the enterprise or his authorized representative).
